For 20 years, the AIDS Legal Council of Chicago (ALCC) has been fighting to protect the legal rights of not just people with HIV, but all of us with regards to this challenging sexually transmitted disease.

On today’s show Justin Hayford, the case manager for the AIDS Legal Council of Chicago join us to talk about HIV, AIDS, sexually transmitted diseases and its legal ramifications.

Marc Felion and Justin HayfordWill we eventually get access to healthcare regardless of the money we make? Does my doctor have a right to tell my family about my HIV status? What are some of the common misconceptions people make when they first get diagnosed for HIV infection?

Although some of you may not be HIV positive, you should still listen to find out what your rights to privacy are when you get tested.

ALCC spends a lot of time and money helping people fight discrimination in employment and health care, and they also provide assistance for infected folks with insurance issues. But they need your help.

LOSE YOURSELF IN THE RHYTHM OF BRAZIL.
Come join us on Wednesday, Sept. 10 from 6-8:30 PM at Sidetrack in Chicago for a delightful Brazilian themed fundraier for the Council. Celebrating 20 years of preserving, promoting and protecting the legal rights of people with HIV/AIDS.

See you there!

What does this elephant share with Amy Winehouse? And you thought Amy Winehouse had problems. After an intensive three-year recovery program, a heroin addicted elephant from a Chinese zoo has finally recovered with his battle with the drug. Poachers fed the elephant bananas laced with heroin as bait and to pacify the creature. Although he goes by the name of Xiguang, we’d love to nickname the drugged up pachyderm Billie Holiday, Amy Winehouse or Boy George. It’s easy to go to rehab when you live in a zoo.

Christian fundamentalist Jay Rogers is praying for John McCain's death after he gets into officeIf only all religious fundamentalists were this generous. Jay Rogers, a militant anti-abortionist from Florida has been praying for the Lord Almighty to snuff out the 2008 Republican Presidential candidate John McCain. Why? So his fundie V.P. baby-momma Sarah Palin will be President of the U.S.A. and usher in a New World Odor of pine-scented insanity.

Michael Phelps loves some blonde girl bootyThe Olympic gold medalist superstar Michael Phelps was spotted last week in a strip bar in Las Vegas grabbing some hot female dance’s butt. Is this a way of him trying to deny rumors of him being gay? Please, leave the guy alone. He’s been swimming his heart out for the past decade, and now he wants a little tail, let him have his fun. Just remember Michael- what happens in Vegas doesn’t always stay in Vegas. So use a condom, ok?

Another thought provoking and interesting show – checked out Justin’s music on iTunes, loved it, bought all the albums! Here’s a thought Marc, you should should introduce Justin to Jen Z they could make beautiful music together, literally.

  2. Pete says:

why can’t justin be this pleasant in the office. i regret all the times i’ve cursed him under my breath.

  3. Jamie says:

GREAT SHOW GUYS: I am going through health insurance issues myself. My Cobra just ended, and I’ve been turned down for private health insurance due to preexisting conditions (which it seems means living over 40 and being overweight.) This is the first time in my life I have been without health insurance. I am in the process of applying for CHIP (talked about briefly on your show) through the state of IL. Another good reason for moving to Chicago. Ohio has no such program.

Being self-employed is getting harder and harder. Socialized medicine would be of great help to all of us entrepreneurs out there!

  4. Marc Felion says:

What Universal Healthcare helping the small business owner? Don’t let the Republicans hear you say that!

  5. PureeTofu says:

I haven’t listened yet, but I was wondering people’s views on:

    http://www.wral.com/news/local/story/3419866/

This guy was charged with health violations because here in NC we have a law that says you can get 2 years of jail for having sex when you’re known HIV+ and don’t use a condom.

Do you think that the law:
    http://ncrules.state.nc.us/ncac/title%2010a%20-%20health%20and%20human%20services/chapter%2041%20-%20epidemiology%20health/subchapter%20a/10a%20ncac%2041a%20.0202.html

Is fair? Too strict? Too loose?

  6. Nick says:

It was interesting listening to how the US healthcare system works (or doesn’t work :D ).
Espcially compared to the healthcare here in sunny Blighty.

Enjoyed the show, keep up the good work.

  7. DC_gay_man says:

The latest Legal Briefs and Case Studies re: STD issues is fascinating. Bring him back and inquire about other states who are or are not progressive on the issues. He’s a great guest.

  8. Legislation like that is SO misguided. I’m sorry, but for one, HIV is not a death sentence.

Also think about how these kind of laws open up so much bullshit lawsuits and laws. So people can sue each other for giving each other colds, the flu, mono, hepatitis.

Anyone with any contagious disease now can be sued if they come into contact with another person and they get their disease? Ridiculous. These kind of laws wont stand up in long-term scrutiny.

  9. Fozziebare says:

What a charming, funny, witty, engaging guest. You should definitely have this man back. I just like hearing him talk.
    Well done, again, guys!

  10. DC_gay_man says:

Even a bad precedent has its roots in the law. I would be interested in having your guest explore the context, the misapplication of the law and enforcement provisions.

For the case cited, I think the public health authority is not an enforcer of law in the USA.

  11. Rhea says:

*kisses and hugs the Canadian soil I’m walking on*

    I

  12. jimberly says:

    Love Justin and the ALCC!!!!!

They are one of the very best agencies in this city – if not the country. Doing such amazing work.

  13. Michael says:

15 years ago I had a friend who got a collections letter that had his name and then “AIDS VICTIM” next to it….he got $150,000.

  14. JustinH says:

Glad to know so many people are interested in HIV legal issues. We’ll keep fighting here at the AIDS Legal Council of Chicago. It’s really amazing that 25 years into the epidemic there is still so much stigma and ignorance. Ah well, onward and upward.

  15. corey says:

Fausto…you didn’t work in the legality of bug chasers???

  16. Sorry I forgot! Justin, is it legal to be a bug chaser??

  17. JustinH says:

Well, I’d say it’s not illegal to be a bug chaser (which I understand to mean a guy who is intentionally trying to get infected with HIV). Illinois law makes it illegal for someone who knows he is HIV to engage in “intimate contact” with someone else without first disclosing his HIV status. But if you tell me you HIV, and I then consent to having sex with you, then neither of us has broken the law.

  18. Branden says:

that’s just not a proper thing to talk about…..bug chasers are sick individuals….

  19. Marc Felion says:

They aren’t sick, they’re trying to get sick!

  20. jimberly says:

“Bug chasers” are more myth than reality. In fact, very few chasers, or “gift givers” exist – but like the Boogie Man, they live on and on and on….

  21. TrickyToro says:

Amazing and informative show guys. Thanks!

Re: OraQuick. Maybe Jim can clarify this for us. I seem to recall some issue with them a while back. Was it giving false negatives or false somethings. Has that been resolved. Is it okey to rely on this method over blood. The thing I’ve always hated about the bloodtests is that 10 days of hellish anxiety which is enough to make you put it off altogether.
