A judge has ruled that content owners must consider fair use before sending takedown notices under the Digital Millennium Copyright Act (“DMCA”). Considering the “shoot them all let God sort them out” legal approach many labels use, it’s a refreshing breath of fresh air for anyone who has any type of content on the internet. Now all those fabulous drag queens who lip sync to songs on MySpace and YouTube only to get it pulled have something to fight back with. I can still see the ocean of drag queens all lip sycning to Jennifer Holiday: “And I am telling you, I’m not going…”
