President Obama speaks on marriage and states rights.

The first and most important thing that needs to be said is that we are very fortunate that no Lesbian, Gay, Bisexual and Transgender activists exercising their right to peaceably assemble were killed near Red Square on May 28, 2011.

While Western media sources have made a great deal out of the fact that a few visiting Western activists got some minor injuries at the hands of the police or fascists, they have been virtually silent about the fact that a leading Russian transgender activist, Anna Komarova, a long-time member of the GayRussia organization, was kicked three or four times in the head while he lay on the pavement, and due only to good fortune was not seriously injured or killed.

Another participant, Elena Kostyuchenko, a journalist with Novaya Gazeta newspaper who came out of the closet as a Lesbian on Saturday, joining the protest with her rainbow flag, was still hospitalized as of my last information from yesterday.  I do not know the nature of her injuries or the prognosis for her recovery.

The primary responsibility for these near-tragedies lies with the fascists, who were charged with only minor crimes, and the Russian government which allowed the serious crimes of assault and attempted murder to occur, despite possessing overwhelming force.  These crimes did not occur in some back alleyway or on an obscure side street, but in broad daylight literally about 50 yards away from Red Square.

Secondary responsibility for these crimes lies with all of those non-Russian governments, including the Obama administration, which valued their trade and military relationships with the Russian government over speaking out for human rights.  President Obama and Secretary of State Clinton, who are fond of talking about human rights violations when they occur in small nations which can be kicked around by the United States, especially if those nations are not allied with the U.S., abysmally failed the test of human rights leadership on Saturday.

After the Russian authorities banned Moscow Pride a few weeks ago – in direct contravention to the 17th Article of the Russian Constitution and last fall’s unanimous decision of the European Court of Human Rights – Moscow Pride organizers directly appealed to all Western embassies to issue public statements to the Russian government before the protest.

All of these governments, including the Obama administration, failed to do so.  The U.S. embassy told Pride organizers that they would simply “monitor the situation.”  As a result, the Russian riot police apparently felt they had a free hand to conduct themselves in the same brutal manner as at previous Prides.

The U.S. embassy in Moscow did finally issue a brief statement about the attacks on Moscow Pride only after the event, signed by a lesser State Department official (http://iipdigital.usembassy.gov/st/english/texttrans/2011/05/20110531095808su6.131709e-02.html?CP.rss=true#axzz1NxHLj0G7).

In Western news articles, the roles of myself, Dan Choi and other international activists in Moscow Pride 2011 were magnified out of all proportion to our actual participation.  LGBT Russians suffered the greatest degree of violence and took by far the greatest risks – and continue to do so – and yet their sufferings have gone almost totally unnoticed by the international press.  The least we can do as people in the West is speak out about impending violence before it happens, and thus help forestall that violence.

If you’re lazy like me, you can watch this video instead. Aside from technical issues, there are obvious grammatical errors. For example, the hospital on the birth certificate did not have that name until 1978 but Obama was born in 1961. Also, they list his father’s race as “African,” a term that is used today but back then, not so much. Not to mention, “African” is not a race. That would be like calling “European” a race or Kim Kardashian an actress.

It seems this controversy will never end. If some sloppy bitch in the White House IT department forgot to merge layers before posting this fraud, shame on you. If this is another internet hoax desgined to make me doubt the greatest man of my time, shame on me.

You probably know this past Friday, Prince William married his sweetheart Kate Middleton amidst a sea of crazy hats, royal pageantry and celebrities.

President Obama has determined that the Defense of Marriage Act is unconstitutional, and that the Department of Justice should no longer defend the measure, which severely limits the potential of states to honor or carry out same-sex marriages, the administration announced Wednesday.

“The President believes that DOMA is unconstitutional. They are no longer going to be defending the cases in the 1st and 2nd circuits,” a person briefed on the decision said, according to the National Journal.

Below is a reply I wrote to someone who questioned my assertion that the Democrats were largely to blame for DADT passage in 1993.

Thanks for your note about my DADT comment.  I remember very well how DADT went down back in 1993, but for the sake of brevity, I couldn’t go into it in my comment.

While you’re right that the Republicans also were disgusting in that affair, the Democrats were if anything more culpable for this anti-gay attack, because they were the ones who held almost all of the reins of power.  And the more you dig into the details about how DADT actually went down, the worse they look.

While it may seem logical to presume that it was the Republicans who led the charge on DADT, it was actually Democrats, led by Senator Sam Nunn (D-GA) who first launched the furor over “gays in the military.”  It is very important to note that back in 2003, like in early 2009, Congressional Republicans were in minorities in both houses, in the political wilderness with seemingly no power to do anything.

In response to Nunn’s Fall 1992 onslaught, the White House went virtually mute.  During the primaries and general election, the Clinton campaign had become renowned for its 24-hours-a-day message response team, which many credited with being key to his winning the Democratic nomination (for example, it saved his political life when they promptly responded to a Clinton sex scandal on the eve of the New Hampshire primary, for example).  So the muted response by Clinton on “gays in the military” was decidedly uncharacteristic.  It showed that the President-elect was not willing to spend not even a dime’s worth of political capital on LGBTs.  Very reminiscent of the current White House.

Back in 1992-93, David Mixner was the most prominent LGBT “Friend of Bill” (Clinton), as members of the President’s kitchen cabinet were known back then.  In the Fall of 1992, Mixner used his bully pulpit as the President-elect’s leading LGBT ally to repeatedly urge the LGBT community to keep quiet about the Clinton’s lack of response to Nunn.  The current President, by contrast, doesn’t do much better.  Out of one side of Obama’s mouth, he says that he wants LGBTs and others in his base to keep up pressure on him, but out of the other side of his mouth he has his spokespeople calling us “idiots” and basically wishes we would go away.

After Nunn initiated the attack on “gays in the military,” the Republican minority smelled blood.  They took the ball from Nunn and ran with it.  Day after day they launched ever more hysterical attacks on “gays in the military,” while our side kept silent.  The result of this one-sided propaganda campaign was that the polls went from being modestly in our favor on the issue, to swinging widely against us.  The “anti-gays in the military” campaign later broadened into what became known as the “Republican Revolution,” with the Democrats getting whipped in the 1994 bi-election and the Democrats accommodating with the 1996 Defense of Marriage Act (passage of which Clinton bragged about in commercials he ran on Christian right radio stations).

But we’re getting ahead of ourselves.  By the Spring of 1993 the Democratic Party, roundly being beaten up in the press by the “gays in the military” furor, was desperate for a way out of the issue.  So just a week before that year’s Lesbian and Gay march on Washington, Clinton’s Secretary of Defense, Les Aspin, floated in the Saturday New York Times a proposal to allow gays in the military – so long as they were segregated into gays-only units!  While implementation of this proposal would have provided fertile fodder for a whole new genre of porn videos, the notion that any late-20th century mainstream politician would countenance segregation in any form was insulting to say the least.

For any LGBTs willing to take their pro-Democratic Party blinders off, Aspin’s bizarre proposal should have been a clear signal as to what direction the administration was going on the issue.  Yet a week later at the march on Washington, almost no one took on the President (to his credit, Larry Kramer made at least a disjointed, confused critique of Clinton, even though as I’ve written elsewhere, Clinton’s anti-gay record in Arkansas was quite extensive).  Instead, speaker after speaker urged LGBTs to stand behind their President, with the result that all of the pressure on Clinton continued to come only from the right.  Our defeat on the issue was a slow-moving train-wreck that most LGBTs should have seen coming, but few did.

The face-saving measure that the Clinton administration eventually came up with was of course, “Don’t Ask, Don’t Tell,” a legislative act which enshrined discrimination into law (previously it had simply been a matter of military regulations) and led to a huge jump in anti-Lesbian and Gay purges over the previous policy.

Finally, it should be noted that a pivotal event in ending the first Republican Revolution wasn’t anything that you can thank the Democrats for.  Following the 1998 lynching of Wyoming’s Matthew Shepard, LGBTs and our allies flooded into the streets in cities around the country.  In Chicago alone I recall there were at least six Matthew Shepard marches and vigils within the first month after his murder.  This widespread, spontaneous revulsion against homophobia and anyone, like the Republicans, who seemed to give aid and comfort to violent homophobia, played a key role in dethroning Newt Gingrich, et al.

Now that we are facing a second Republican Revolution, this history provides some important pointers to how we can defeat Sarah Palin, the Tea Partiers, et al.

Finally, to talk only about DADT repeal in the narrow context of LGBT rights and ignore the devastating impact of the U.S. military on the peoples of the world would be arrogance in the extreme.  There are over 1000 American military bases outside of the U.S., mostly in countries whose peoples don’t want them there, helping prop up scores of U.S.-allied thugs who are widely hated by those they rule over.

For those naive enough to persist in thinking that American troops are abroad to “serve” — there to help other peoples or to “defend our freedom,” I need only point to the Wikileaks revelations.   The U.S. is responsible for half the world’s military spending – that’s not defense, that’s empire.

Stacked up against the continuing enormous waste of lives and resources caused by the American military, the injustice of DADT paled by comparison.  I don’t expect HRC or the Servicemembers Legal Defense Network to ever depart from their myopic “rights-for-gays-only” approach.  But to the vast majority of LGBT people who identify with neither of those groups, I would say this:  If you want solidarity from non-LGBT people for our struggles, such as in referenda campaigns (which we’ve uniformly lost over the past few decades), then we cannot fail to give solidarity to the justice struggles of “others,” many of whom are themselves LGBT.

Yesterday, Attorney General Eric Holder led a Pride ceremony at the Justice Department and today, President Obama will greet LGBT Americans at a White House Pride Month Reception. Good week. However, its really been a good month to be queer, with the Federal Government making moves to sniff out and secure dozens of benefits for lesbian, gay, bisexual or transgender headed families–especially for same-sex couples where one partner works for the Federal Government. How? Elementary, my dear Watson!

First, in April, the President announced plans to order hospitals to grant visitation rights to same-sex partners. This was followed by the extension of Federal Employee benefits to same-sex partners of Federal workers and the Justice Department applying intimate partner protections in the Violence Against Women Act to same-sex couples all in early June.

The biggest news yet came last night when sources revealed that Secretary of Labor, Hilda Solis planned a Wednesday announcement requiring employers extend some of the benefits of the 1993 Family and Medical Leave Act to same-sex partner headed households. It seems that the Federal Government is sleuthing through the law and finding tiny bits and pieces of benefits that the Defense of Marriage Act does not prevent them from offering. According to Chris Geidner of MetroWeekly:

“Changes to be announced on Wednesday regarding expansion of family leave benefits for gay and lesbian families will be limited to an expansion related to individuals who are the non-legal, non biological parents of their same-sex partner’s children, a person familiar with the coming changes told Metro Weekly on Monday evening.

[...]

The changes will be limited to allowing individuals who are the non-legal, non biological parents of their same-sex partner’s children to take FMLA leave to care for those children, according to the person.

The changes, the person said, also would apply if one’s partner is having a child that is not the person’s child biologically or legally or if a person’s same-sex partner is adopting a child and the person, due to state law, doesn’t have a legal relationship to that child.”

Rep. Carolyn B. Maloney (D-NY) introduced a bill called the Family and Medical Leave Inclusion Act to allow workers to take leave to care for a domestic partner or a same-sex spouse by amending the FMLA. The bill would expand the definition of “spouse” to include “a same-sex spouse as determined under applicable state law.” This would be the best choice, however, seeing our Detective in Chief trying his best to find the little loopholes in DOMA is heartening.

But its not all joy in Mudville.

Sunday we also learned that Defense Secretary Gates confirmed that the presence of language repealing “Don’t Ask, Don’t Tell” in the Defense Authorization bill will not prevent the President from vetoing the bill if the Senate does not remove certain spending provisions. If I were a DADT repeal advocate, I’d be on the phone with my Senator right now telling them to pull out the funding of the C-17 and the alternative engine for joint strike fighter so that a veto is avoided. Now is the time to partner with those groups that are also vying to cut funding for those programs.

All is not terrible, however. Rahm Emanuel is quitting!

I’m elated by this news considering Obama’s chilly response to the charges that he wasn’t doing enough for the LGBT community. If this legislation can get pushed through, I think my faith will be restored in the administration. I know it’s not marriage equality, but the repeal of DADT would be a major milestone in the history of our community. This will not only stop the senseless loss of capable military personnel, but also allow currently enlisted gays and lesbians to be able to live their lives without fear.

The Good: During her deanship at Harvard Law, Kagan supported policy that prevented military recruiters from recruiting on campus, because she felt that the military’s “Don’t Ask, Don’t Tell” policy discriminated against gays and lesbians, even going so far as to say DADT was “a profound wrong – a moral injustice of the first order.” She is a very vocal supporter of the First Amendment and has written often on the subject. Kagan regularly butts heads with Chief Justice John Roberts and will likely be a foil to his consistent voting record which favors large corporations.

The Bad: The military recruitment thing could come back to haunt her in her confirmation hearings. Conservatives will call this “liberal elitism” at its highest form. She also faces heat from the left as she has defended the White House’s continued use of “battlefield law” to detain suspected terrorists indefinitely without trial.

The Ugly: Unfortunately, time seems to have soften Kagan’s opinions on LGBT rights. She has said that she doesn’t believe the right to same-sex marriage is guaranteed in the Constitution. She has also stated that the government’s ability to defend DADT is strong. Kagan is single and has no children which means it will only be a matter of time before conservatives begin whispering the dreaded “L” word. She has never gone public with her sexuality and I believe this will be a serious point of contention with her nomination.

Is Obama now saying he’s for marriage equality? At yesterday’s Prayer Breakfast held by the evil covert group known as “The Family,” both President Obama and Secretary of State Hillary Clinton condemned the organizations ties to the “kill gays” legislation in Uganda.

President Obama called the bill “odious” and remarkably stated “We may disagree about gay marriage, but surely we can agree that it is unconscionable to target gays and lesbians for who they are — whether it’s here in the United States or … most recently in Uganda.” Well, if “The Family” is against gay marriage and he disagrees with them, does that means he’s for it?

But those of us who take a broad view of human rights remember a similar pledge being made about closing Guantanamo Bay in a year, the deadline for which passed, a pledge that’s made even more hollow by insulting proposals like Guantanamo on the Mississippi, continued military tribunals, and extraordinary renditions.

In a move reminiscent of Defense Secretary Les Aspin in 1993 when President Clinton’s pledge to end the ban on gays was swiftly sinking, a few weeks ago administration officials floated the idea of “solving” employment discrimination in the military by setting up separate units for openly gay and lesbian soldiers — the odious stench of ‘separate but equal’ institutions in the 21st Century.

President Obama tonight noted that “We face a deficit of trust.” What he failed to note was that with broken promises and proposals like “separate but equal,” is it any wonder?

The openly gay actress, who has won rave reviews for her turn as tough cheerleading  Coach SueSylvester in the hit show, insists the decision to ban gay marriage in California in 2008 shouldn’t have taken place – because the majority don’t have the right to vote on the lives the minority.

And Lynch is angry Obama hasn’t stepped up to allow gay marriage across the U.S. – comparing the ongoing battle to the civil rights movement in ’60s America.

She tells Britain’s Guardian newspaper, “Shouldn’t there be safeguards against the majority voting on the rights of a minority? If people voted on civil rights in the ’60s, it would have never happened. It took somebody like (U.S. President) Lyndon Johnson going, ‘F all of you! I’m going to do this.’ Obama won’t do it. He’s a huge disappointment to me.”

What a miserable year! As 2009 comes to an end, we’re reminded of what a terrible year it was for not just the nation, but for gay folks as well.

Our hopes for the equality promised by President Obama were dashed as hate ran rampant across the world. What happened?

Blogger Alicia Eller at Chicago Now comprised a list of “The Top 25 Homophobic Moments of 2009″ and it’s getting a lot of traffic. Some of the highlights include- Carrie Prejean’s opposite marriage, manipulative sports officials leaking the inter-sex status of champion Semenaya, and politicians caving into the demands of fundamentalists with regards to marriage equality.

But it’s not all bad- 2009 was also a year where millions of people felt empowered to stand up and say “I want my rights.” More people came out of the closet and a lot of people had some sexy good times.
