We got a little excited talking about gay robots, so we joined AJ in his Trandroid getup.

In reality most robots are just fancy machines that help build stuff, or glorified sex dolls that help us get off. But in many sci-fi books and films, robots come off as kind of gay.

Not so fast, says the 9th Circuit Court.

Judge Walker’s decision from his Northern California district Federal Court initially had no sort of limit blocking its immediate effect. Stories of savvy and well-prepared lesbian couples sliding a quick wedding in under the wire wafted over from California–though none were confirmed to my knowledge. However, Judge Walker quickly implemented a temporary stay on his August 4th decision within hours–a rule that prevents a Judge’s decision from going into effect right away. He asked for arguments from both sides about whether or not to lift the stay.

Prop 8 supporters wanted a stay to preserve the status quo and prevent any more same-sex couples from marrying. The Plaintiffs argued against it, saying the ruling should take immediate effect and there would be no harm done to the defendants if it did go into immediate effect.

All of this was playing out as the Defendants in Perry V Schwarzenegger–the folks who love to hate gays–were preparing to appeal Walker’s decision in the next highest court, the 9th Circuit Court of appeals. The 9th Circuit is an appellate court that covers a handful of Western states that folks can appeal their cases to when they don’t like their Federal Court’s decision. The next court of appeals above the 9th Circuit is the United States Supreme Court, and there ain’t nothin’ after that.

On August 12, Judge Walker announced he would be lifting his stay, setting it to expire August 18th.

However, the Defendants took their request for a stay to the 9th Circuit and Monday August 16th, the 9th Court put a hold on Judge Walker’s decision. Yet, they also fast-tracked the appeal, demanding all arguments be filed much quicker than expected, and setting a hearing for early December. This means that if Meg Whitman wins Governor of California, she’s not going to be very involved in the case. That’s good news–the court could throw the case out before she even has a chance to intervene.

We hope that doesn’t happen. We hope Jerry Brown becomes Governor of California. Jerry Brown refused to defend Prop 8 in Court. Neither did Governor Schwarzenegger. When neither the Governor nor the State of California–represented by Brown–would defend the law in court, not only was it a bold and progressive move by two allies, but it also threw the case into a curious legal limbo that will make it less likely to be successful in the 9th or the Supreme Court.

The “Defendants” in the case don’t exactly meet the muster of what a “Defendant” ought to be in a case–which may lead the 9th Circuit to throw out the appeal. However, if they do, Walker’s decision will only have effect in California. Likewise, if the 9th Circuit gives the Defense “standing” and still uphold Walker’s decision, but the Supreme Court does not give them standing, the decision would only take effect in the states within the 9th Circuit.

However, if either of the two courts overturn Judge Walker’s decision, we will instead have a very sad situation on our hands. Judge Walker’s decision will go into effect nowhere.

The perfect situation, however, would be that the Supreme Court upholds Judge Walker’s decision that barring marriage is unconstitutional–leading to marriage equality being the law of the land.

Sure you did.

If you watched any of the coverage of the decision that Judge Walker wrote in Perry V Schwarzenegger striking down Prop 8, you heard that he is gay. Its been a massive part of the coverage, and that coverage has only fueled Right Wing rage over the decision even more. Fox was first to say he should have recused himself from the case because he’s gay. By the same token shouldn’t a straight Judge also recuse themselves because they’re not gay? Then, like lemmings, the rest of the mainstream media followed.

Really National Public Radio? Et tu Brute?

And their source of this information? A February 2010 San Francisco Chronicle piece that covered all of the fringe right wing rumors about Judge Walker being gay, at one point calling it an “open secret,” but not naming names, asking any sources, or finding any hard evidence. Its as baseless as anything, and here we have an entire media smear campaign grounded in this. The Right Wing is using as its ammo a piece that was covering their own frantic and unfounded hysteria–and its working.

But what about this “open secret?” Sure, there are lots of stories and rumors about Judge Walker’s gayness circulating around in gossip circles, but he has never come out and never substantiated these rumors. Neither has Queen Latifah, Anderson Cooper, Aaron Schock, Lindsey Graham, Mitch McConnell and Charlie Crist. Yet the mainstream media has avoided any coverage of their gayness. What’s the difference? There really is none. Judge Walker wrote a decision that had something to do with gay people, and he didn’t posture for the cameras, berate the gays for existing and distance himself as far as possible from our community.

The others–especially the last three–are making careers out of ruining the lives of gays and lesbians.

The media only cares about outing closeted gays when they aren’t working actively to suppress the community.

Federal Court Declares California’s Proposition 8 Unconstitutional

Trial Judge Rules that Ban on Marriage Equality Violates Guarantees of Equal Protection, Due Process

WASHINGTON – The Human Rights Campaign – the nation’s largest lesbian, gay, bisexual and transgender (LGBT) civil rights organization – today praised the historic decision of Chief Judge Vaughn Walker of the U.S. District Court for the Northern District of California in Perry v. Schwarzenegger, which declared that the amendment to the California Constitution barring marriage for same-sex couples, adopted in November 2008 as Proposition 8, violates the U.S. Constitution’s guarantees of equal protection and due process.

“After hearing extensive evidence in support of marriage equality, and essentially no defense of the discrimination wrought by Prop 8, Judge Walker reached the same conclusion we have always known to be true – the Constitution’s protections are for all Americans, including the lesbian, gay, bisexual and transgender community,” said HRC President Joe Solmonese. “We thank the courageous plaintiff couples, the American Foundation for Equal Rights, and attorneys Ted Olson and David Boies for their tremendous efforts leading to today’s decision and their ongoing commitment as the case moves forward on appeal. The battle for marriage equality continues, and we must all continue our work – in courthouses and statehouses, in church pews and living rooms – until equality is reality for LGBT people and our families everywhere.”

In response to a 2008 decision by the California Supreme Court ending marriage discrimination in the state, anti-equality forces succeeded in placing a constitutional amendment on the November ballot. Despite over 18,000 same-sex couples having married, California voters adopted the amendment, known as Proposition 8. After the California Supreme Court determined in 2009 that the adoption of Prop 8 did not itself violate the California Constitution, two plaintiff couples — Kris Perry and Sandy Stier and Paul Katami and Jeff Zarrillo – filed suit against the State of California in federal court, represented by attorneys Ted Olson and David Boies and supported by the American Foundation for Equal Rights. The proponents of Prop 8 intervened in the case to defend the constitutionality of the amendment. Judge Walker held a historic trial in January, in which the plaintiffs presented substantial testimony and evidence to show that Prop 8’s only purpose is to discriminate against same-sex couples. Both sides have previously indicated that they would appeal Judge Walker’s decision to the U.S. Court of Appeals for the Ninth Circuit, and the case may ultimately be heard by the U.S. Supreme Court.

It’s the Day of Decision. We’ll soon know how Judge Walker decides on the Prop 8 Trial in California.

Here’s a concise Prop 8 FAQ to answer many of the questions on what today is all about.

I’ll update this throughout the day.

Despite some folks’ best efforts to pin Prop 8 on the straight black community or Fresno or something, it seems ignorant hot-heads are eating their words today.

A massive study initiated by the LGBT Mentoring Project was just released that puts the blame for the loss back squarely where it belongs–on us.

A team of data experts analyzed all of the polls leading up to the election to isolate every possible factor that led up to the November 2008 failure on Prop 8. In fact, it seems, that our ads shot our cause in the foot–creating confusion about what Prop 8 was actually about. While a majority of African American voters supported Prop 8 in the end, about the same number supported it in the beginning: few were swayed by the other side’s ads. The other side won through the ads by initiating a major voter turn around with mostly white Democrats:

“In the final six weeks of the campaigns, after exposure to TV ads on which both sides spent a combined $60 million, approximately 687,000 voters moved towards favoring the ban on same-sex marriage. More than 500,000 of these voters were parents with children under the age of 18 living at home. Other groups of voters who moved away from same-sex marriage in large numbers included white Democrats, Independents, and voters in the Greater Bay Area. Prop 8 passed by a margin of just under 600,000 votes.”

The film is a  fascinating, compelling and heart breaking recounting of the Mormon Church’s 15+ year covert battle to deny Gays the right to marry and specifically the 22 million dollar push behind the Prop 8 fight in California in 2008. The film relies on objective proof (documents, video, audio broadcast, campaign training films, eye witness testimony and commercials) of the Church’s involvement.  Also explores the harrowing emotional and psychological toll the Church’s decades long obsession with homosexuality has had on it’s Gay members.

While the film confirmed what I already understood to be true from my own personal experience as a former member of the Mormon Church and with the campaign as it played out in real life, the film never the less had fresh lessons to teach me about the depth of the Church’s campaign and new ways of inspiring me to action as a Gay man.

My only criticism of the film is that the films focus is entirely on the Mormon Church’s involvement in the campaign and I would love to see a complete holistic examination of the campaign from both sides as I do believe that there were failures on the Equality CA LGBT side of the fight that contributed to the success of the Mormon Church’s campaign.

A must see for anyone interested in civil rights, politics, the separation of church and state and LGBT issues.  The film is playing now in limited release and is also avaialbe nationwide on Comcast On-Demand (though there are reports the film is mysteriously being blocked in Utah – the story continues?)

Olson & Boies

Olson and Boies, adversaries in 2000, put together one of the most rock-solid cases never to be broadcast on YouTube (because the Supreme Court said no!). Not only did Olson and Boies set up a strong case for the recognition of marriage equality in California and a striking down of the misguided voter referendum, Prop 8; Olson and Boies ripped apart witness after witness from the defense, even getting many of the defense witnesses to agree with the plaintiffs in their cross examinations and questioning.

Two weeks ago, the Honorable Judge Vaughn Walker released a series of questions that he guided each side to address during closing arguments. The questions–meant to assist Walker in crafting his decision–seem to allude that the plaintiffs did an excellent job in presenting their case and now he needs to examine the extent to which his ruling can push the boundaries.

However, yesterday again, the plaintiffs showed they clearly have a better grasp of reality than the defense, which the pro-Prop 8 side arguing that not only should the plaintiffs be ruled against, but that the 18,000 “limited edition” California equal marriages that occurred before Prop 8 passed ought to be invalidated. Meanwhile, Olson and Boies instead argued:

“We conclude this trial, your honor, where we began. This case is about marriage and equality. The fundamental constitutional right to marry has been taken away from the plaintiffs, and tens of thousands of similarly situated Californians. Their state has rewritten its constitution in order to place them into a special disfavored category where their most intimate personal relationships are not valid, not recognized and second rate… There is not a compelling governmental interest to put the plaintiffs in a class like this and take away what the Supreme Court has called a fundamental right, a right of liberty, privacy, association, intimacy and autonomy.”

And also:

“Our fundamental rights can’t be taken away unless the state has a very, very fundamental, strong, compelling reason to do so and acts with surgical precision so that it takes no more than the compelling reason justifies… Their state has stigmatized them as unworthy of marriage, different, and less respected… This is discrimination, the taking away from a fundamental right as articulated by the Supreme Court… The Supreme Court has said that marriage is the most important relation in life. Now that’s being withheld from the plaintiffs. Marriage, the Supreme Court has said again and again, is a component of liberty, privacy, spirituality and autonomy. [Prop 8.] prevents a complete choice as to marriage and designates gays and lesbians as less worthy and entitled to less honor, less status and fewer benefits. Marriage is special, the experts tell us. Domestic partnerships and civil unions are pale comparisons… This law is discriminatory. The evidence is overwhelming that it imposes great social harm on individuals who are our equals. They are members of our society. They pay their taxes. They want to form a household. They want to raise their children in happiness and in the same way that their neighbors do. We are imposing great damage on them by the institution of the State of California saying they are different and they cannot have the happiness, they cannot have the privacy, they cannot have the liberty, they cannot have the intimate association in the context of a marriage that the rest of our citizens do.”

Judge Walker is expected to rule sometime this summer.

Closing arguments were made in the landmark Proposition 8 case yesterday in California, where not just the future of marriage equality but gay rights hang in the balance.

Even though the judge in the case is a gay, and the haters’ lawyers argued the case poorly, nobody knows for sure how it’s going to turn out.

A highlight of the closing arguments is the Attorney Charles Cooper ridiculous assertion that keeping same sex couples from marrying and having children was essential for the “survival of the human race.”

Anyway, Sir Elton got $1 million to play Rush Limbaugh’s 4th wedding, even though Rush Limbaugh is against Elton from getting even one. I am pretty sure that this constitutes throwing our community under the bus.

However, another very unlikely pair teamed up this week.

American Foundation for Equal Rights–the organization that brought the case to overturn California’s discriminatory Proposition 8 to Judge Walker’s Federal Court–has two new Advisory Board chairs. Robert A. Levy, chairman of the libertarian Cato Institute, and John Podesta, President and CEO of the progressive Center for American Progress, have been named Co-chairs of the Foundation’s Advisory Board, and they celebrated by publishing a jointly-written Washington Post editorial blasting conservative opposition to marriage equality:

“Although we serve, respectively, as president of the progressive Center for American Progress and chairman of the libertarian Cato Institute, we are not joining the AFER advisory board to present a ‘bi-partisan’ front. Rather, we have come together in a non-partisan fashion, because the principle of equality before the law transcends the left-right divide and cuts to the very core of our nation’s character… Simply put, this is not about politics; it’s about an indispensable right vested in all Americans.”

They make a strong patriotic case for LGBT equality, “No less than the constitutional rights of millions of American are at stake. But now that the public appears to be catching up with the Constitution, just a little more leadership from the courts would be the perfect prescription for a free society.”

If straight men are joining on the “Gay is A-OK” bandwagon, it won’t be long before the floodgates open, and conservatives change their tune to try to lure supporters.

Maybe we can get Marsian to do the voice of Cookie Puss or Fausto as Eartha Kitt. I know Rick Aiello does a fabulous Miss Piggy and maybe Michael Lehet could return as horrible homophobe William Tam. Prop 8 Trial Testimony Gets a Marisa Tomei Makeover

Today the Courage Campaign, an online organizing network for progressive causes, launched a Web site dedicated to re-enactments of the ongoing trial. At equalityontrial.org, they’ve posted videos of a handful of celebrities — including Oscar winner Marisa Tomei — giving dramatic readings of the court proceedings.

Acting in a West Hollywood park Tomei portrays Kristin Perry, one of the lesbian plaintiffs in the case seeking to marry her partner. Actor Josh Lucas plays Theodore Olson, one of the legal powerhouses supporting the challenge. The scene portrays the plaintiffs’ argument that gays and lesbians face discrimination in their everyday lives.
