    GREAT SHOW GUYS: I am going through health insurance issues myself. My Cobra just ended, and I’ve been turned down for private health insurance due to preexisting conditions (which it seems means living over 40 and being overweight.) This is the first time in my life I have been without health insurance. I am in the process of applying for CHIP (talked about briefly on your show) through the state of IL. Another good reason for moving to Chicago. Ohio has no such program.

    Being self-employed is getting harder and harder. Socialized medicine would be of great help to all of us entrepreneurs out there!

    I haven’t listened yet, but I was wondering people’s views on:

    This guy was charged with health violations because here in NC we have a law that says you can get 2 years of jail for having sex when you’re known HIV+ and don’t use a condom.

    Do you think that the law:

    Is fair? Too strict? Too loose?

  7. The latest Legal Briefs and Case Studies re: STD issues is fascinating. Bring him back and inquire about other states who are or are not progressive on the issues. He’s a great guest.

  8. Legislation like that is SO misguided. I’m sorry, but for one, HIV is not a death sentence.

    Also think about how these kind of laws open up so much bullshit lawsuits and laws. So people can sue each other for giving each other colds, the flu, mono, hepatitis.

    Anyone with any contagious disease now can be sued if they come into contact with another person and they get their disease? Ridiculous. These kind of laws wont stand up in long-term scrutiny.

  10. Even a bad precedent has its roots in the law. I would be interested in having your guest explore the context, the misapplication of the law and enforcement provisions.

    For the case cited, I think the public health authority is not an enforcer of law in the USA.

    15 years ago I had a friend who got a collections letter that had his name and then “AIDS VICTIM” next to it….he got $150,000.

    Glad to know so many people are interested in HIV legal issues. We’ll keep fighting here at the AIDS Legal Council of Chicago. It’s really amazing that 25 years into the epidemic there is still so much stigma and ignorance. Ah well, onward and upward.

    Well, I’d say it’s not illegal to be a bug chaser (which I understand to mean a guy who is intentionally trying to get infected with HIV). Illinois law makes it illegal for someone who knows he is HIV to engage in “intimate contact” with someone else without first disclosing his HIV status. But if you tell me you HIV, and I then consent to having sex with you, then neither of us has broken the law.

    “Bug chasers” are more myth than reality. In fact, very few chasers, or “gift givers” exist – but like the Boogie Man, they live on and on and on….

    Re: OraQuick. Maybe Jim can clarify this for us. I seem to recall some issue with them a while back. Was it giving false negatives or false somethings. Has that been resolved. Is it okey to rely on this method over blood. The thing I’ve always hated about the bloodtests is that 10 days of hellish anxiety which is enough to make you put it off altogether.
